1. Acceptance of Terms

By accessing or using the Cascade Head Music website ("Site") and our educational services ("Services"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookies Policy.

If you do not agree to these Terms, you may not access or use our Services. These Terms apply to all visitors, users, students, parents/guardians, and others who access or use the Services.

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

2. Services Description

Cascade Head Music provides music education services including but not limited to:

  • Private and group music lessons
  • Music theory and ear training instruction
  • Examination preparation and certification
  • Workshops, masterclasses, and recitals
  • Digital learning resources and materials
  • Performance opportunities

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, including the availability of any feature, database, or content.

All descriptions of Services and pricing are subject to change at any time without notice. We reserve the right to discontinue any Service at any time. Any offer for any Service made on this site is void where prohibited.

3. Registration & Accounts

Account Creation

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

Parental Accounts

For students under 18 years of age, a parent or legal guardian must create and maintain the account. Parents/guardians are responsible for all activities conducted through their child's account.

Account Termination

We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading.

4. Payments & Refunds

Fees and Payment

You agree to pay all fees and charges associated with your account on a timely basis. All fees are non-refundable except as expressly stated in these Terms or required by law.

Payment Methods

We accept various payment methods including credit cards, debit cards, and electronic bank transfers. By providing a payment method, you represent that you are authorized to use the payment method.

Billing Cycle

Services are billed in advance on a monthly, quarterly, or annual basis, as specified in your enrollment agreement. Fees are automatically charged to your designated payment method unless you cancel according to our cancellation policy.

Refund Policy

We offer refunds under the following circumstances:

  • Cancellation within 48 hours of initial registration (full refund)
  • Teacher unavailability without suitable replacement (pro-rated refund)
  • Documented medical issues preventing participation (pro-rated refund with documentation)

All refund requests must be submitted in writing to accounts@cascadeheadmusic.com within 30 days of the charge date.

5. Cancellations & Rescheduling

Lesson Cancellations

Students must provide at least 24 hours notice for lesson cancellations to be eligible for a makeup lesson. Lessons canceled with less than 24 hours notice will be charged in full.

Makeup Lessons

Makeup lessons must be scheduled within 30 days of the canceled lesson. Unused makeup lessons expire after 30 days.

Program Withdrawal

To withdraw from any program, written notice must be provided at least 14 days before the next billing cycle. Withdrawals take effect at the end of the current billing period.

Teacher Cancellations

If a teacher needs to cancel a lesson, we will provide a substitute teacher or reschedule the lesson at no additional cost to the student.

6. User Conduct

As a condition of using our Services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Engage in harassing, threatening, or abusive behavior toward staff or other students
  • Upload or transmit viruses or any other malicious code
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Services or servers
  • Use the Services for any illegal or unauthorized purpose
  • Share account credentials with others
  • Record lessons without explicit permission

We reserve the right to terminate your access to the Services for violating any of these conduct provisions.

7. Intellectual Property

Our Content

All content provided through our Services, including but not limited to lesson materials, curricula, videos, audio recordings, worksheets, and other educational resources, is the property of Cascade Head Music or our licensors and is protected by copyright and other intellectual property laws.

License Grant

We grant you a limited, non-exclusive, non-transferable license to access and use our educational materials for your personal, non-commercial educational purposes only.

Restrictions

You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any other purposes without our prior written consent.

User Content

By submitting or posting any content on our platforms, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for educational and promotional purposes.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Cascade Head Music shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our Services
  • Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Services

In no event shall our total liability to you for all damages exceed the amount you have paid to Cascade Head Music in the last six (6) months, or if greater, one hundred Canadian dollars (CAD $100).

9. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or notify us at accounts@cascadeheadmusic.com.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the courts of the Province of New Brunswick. You consent to the personal jurisdiction of these courts and waive any objections to the exercise of jurisdiction over you by such courts.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
